Program Information & Requirements
Court diversion, also known as pretrial diversion, is a program that allows defendants to avoid a criminal conviction by completing an alternative sentencing option. Diversion programs are available at the federal level and in most states, and can apply to first-time arrests or non-violent misdemeanor offenses.
For example: Someone charged with a traffic offense may be allowed to attend “driving school” to have charges reduced or dropped, and possibly avoiding “points” on one’s license.
Carolina Public Safety will allow those charged with an offense relating to possession or carrying of a weapon to attend the NC Concealed Handgun Course as a diversion program.
Those charged with a crime relating to the possession or carrying of a weapon must reach out to Carolina Public Safety BEFORE attending a class. Carolina Public Safety will require your attorney’s name and will need to make contact with them prior to you taking the class. In coordination with your attorney, Carolina Public Safety will work with the DA’s Office and court system to facilitate this program and submission of any needed documentation.
There are two options for this program, your attorney will direct which option we follow.
Option 1:
Prospective students who are not prohibited from possessing a firearm will be allowed to take the course in it’s entirety. Those successfully completing the course will be issued a NC Concealed Handgun Training Certificate and a Letter of Memorandum will be given to the individual and the individual’s attorney. To choose Option 1, your attorney must verify you are legally allowed to possess a firearm. This verification must be in writing.
Option 2:
Prospective students who are prohibited from possessing a firearm will be allowed to take the classroom portion only. Students attending under this option will not possess, handle, or use firearms during the course. Those successfully completing the course a Letter of Memorandum will be given to the individual and the individual’s attorney.
